Illegal use

webanchor.net does not allow that its services be used for any kind of criminal activities in any way or any activities repugnant to any law enforced in the area. To control this webanchor reserves the rights to report such activities to the concerned authorities. Webanchor strongly condem and prohibit that its services be used for the purpose of harrasment ,harm to minors or acts such as child pornography.Furthermore webanchor prohibits its services to be used convey threats of any kind to anyone. This includes threats to harm body or property. Spam and Pishing policy Webanchor.net does not allow spam mails which include; Manipulating identifiers, such as email headers and images,to disguise the origin of any content transmitted using the Service. Using or causing to be used Service computer systems to facilitate the transmission of unsolicited or unauthorized material. This includes any promotional materials, URLs, "junk mail," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation that you may upload, post, email, transmit, or otherwise make available. Using "robots" or otherwise harvesting other's email addresses from the Service. Sending a message that directs a recipient to a web site that uses a third party's branding, trademarks and or other intellectual property to mislead the recipient into believing that he is using a site authorized by that third party. To control such spam mails the account involved, whether it is shared,VPS or dedicated server,will be suspended and if such spam mails are not stopped ,will be terminated. Fraudulent activities Webanchor strictly prohibits that its services be used for any kind of fraudulent activities which includes being involved in any type of financial scam such as "pyramid schemes"and "chain letters".It further includes making fraudulent offers for slling or buying any products,items or services. Impersonation Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Misuse the name of any Government entity is strictly prohibited and Webanchor.net reserves the rights to shutdown services at request of any Government entity. Company domains registered by employees or third parties shall be considered under the ownership of organizatoin and can be claimed back after providing all necessary information. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.

Unsolicited commercial e-mail / Unsolicited bulk e-mail (SPAM)

Webanchor prohibits its services to be used for transmission of any kind of unsolicited commercial or unsolicited bulk e-mail.Any account involved in such SPAM will be immediately suspended and on further continuation of such mails ,will be terminated.

E-mail / News Bombing

Malicious intent to impede another person's use of electronic mail services or news will result in the immediate suspension and afterwards termination of the offending Webanchor.net account.

E-mail / Message Forging

Webanchor.net does not allow its services to be used for forging any message header, in part or whole, of any electronic transmission.

Hourly E-mail Limit

Webanchor.net allows clients to send per hour e-mails strictly in accordance with their packages. Clients can contact to our Sales Team and can take appropriate email solution if they may want to send more e-mails within an hour.

Usenet Spaming

Webanchor.net prohibits the use of its network for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

Unauthorized access

Webanchor.net does not allow its service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Webanchor.Net's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending account is subject to immediate termination.

Copyright or trademark infringement

Infringment of any Copyright,trademark,patent,trade secret or other proprietany rights of any third party, by any Webanchor.net account, using Webanchor.net service to transmit any material(by e-mail,uploading,posting or otherwise) is prohibited.This also includes the unauthorised copying of copyrighted material,the digitization and distribution of photographs from books, magazines,or any other copyrighted sources. This further includes the unauthorised transmittal of copyrighted software.Any account or server involved in such activities will be suspended and if such activities continue, terminated.

Collection of personal data

Webanchor.net does not allow use of its service to collect, or attempt to collect, personal information about third parties without their knowledge or consent

Network disruptions and unfriendly activity

Webanchor.net do not allow to use its service for any activity that affects the ability of other people or systems to use Webanchor.net Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. Webanchor.net will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.

Distribution of Viruses

Webanchor.net prohibits intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems. Such an offense will result in the immediate termination of the offending account.

Inappropriate Use of Software.

Pinging while using Webanchor.net services or using of software or any other device that would facilitate a continued connection is not allowed and will result in suspension of service.

Third Party Accountability

In case of any activity, by third party using Webanchor.net account ,that violate guidelines created within the acceptable Policy,the Webanchor .net subscriber will be held responsible and accountable.

Inodes Limit

Maximum allowed number of inodes at Webanchor.net shared hosting servers are 1,00,000. Any shared hosting account exceeding this limit will be considered as violating our hosting policy and system will shutdown all services automatically. Any account having more than 1,00,000 inodes or having more than 20GB disk space will be removed from our weekly backup system. Data backup service is not at FOC basis and shall be ordered in advance.

Violation Of Virtual Accounts of Webanchor.net.

Webanchor.net strictly forbids to host pornographic content or IRC servers on Virtual Server Accounts. Virtual Server Accounts found hosting this material would be subject to immediate cancellation without refund. In case of any complaint regarding abuse etc. Webanchor.net reserves the rights to change password of Virtual Machine and take necessary action.

Billing and Payment Information

Prepayment.

It is the responsibility of the webanchor.net account holders to ensure that their payment information is up to date, and that all invoices are paid on time. subscribersare are to pay for the Services in advance of the time period during which such Services are provided. Subject to applicable laws, rules, and regulations, payments received will be first applied to the oldest outstanding invoice in the billing account of the subscribers.

Autorenewal.

Unless otherwise provided and that until and unless the account holders notify Webanchor.net to cancel the Services, account holders will be billed on an automatically recurring basis to prevent any disruption of Services, using credit card or other billing information on file with us.

Taxes.

Listed fees for the Services do not include any applicable sales, use, revenue, excise or other taxes imposed by any taxing authority. Any applicable taxes will be added to Webacchor.net`s invoice as a separate charge to be paid by the subscribers. All fees are non-refundable when paid unless otherwise stated.

Late Payment.

All invoices must be paid within two(2) days of the invoice due date. Any invoice that is outstanding for more than two (2) days may result in the suspension or termination of Services. Access to the account will not be restored until payment has been received. If account holders fail to pay the fees as specified herein, Webanchor.net may suspend or terminate the defaulter account and pursue the collection costs incurred by Webanchor.net, including without limitation, any arbitration and legal fees, and reasonable attorneys' fees. Webanchor.net will not activate new orders or activate new packages for customers who have an outstanding balance on their account.

Dedicated servers payment

Dedicated servers are subject to being reclaimed and all content deleted if account holders fail to make a timely payment. If a late payment is made, the dedicated servers will not be automatically reactivated . Webanchor.net is to be contacted directly after making a late payment to reactivate the dedicated server.

Domain Payments.

It is solely the responsibility of the subscriber to notify Webanchor.net Billing department via a support ticket created from support@webanchor.net after purchasing a domain. Domain renewal notices are provided as a courtesy reminder and Webanchor.net is not responsible for a failure to renew a domain or a failure to notify a customer about a domain's renewal. Domain renewals are billed and renewed thirty (30) days before the renew date.

Fraud.

It is a violation of this Agreement for the account holders to misuse or fraudulently use credit cards, charge cards, electronic funds transfers, electronic checks, or any other payment method. Webanchor.net may report any such misuse or fraudulent use, as determined in arereporting services, financial institutions and/or credit card companies.

Invoice Disputes.

As Invoice for all account holders of Webanchor.net is generated fifteen (15)days prior to their respective due dates therefore any dispute regarding invoice(any charge or payment processed by Webanchor.net) is supossed to be settled before due dates.however two more days after due dates are further allowed for the purpose. . If any questions concerning a charge on any account arise, billing department is to be contacted for assistance.

Money-Back Guarantee.

If an account with a thirty (30) day money-back guarantee is purchased and then cancelled within the first thirty (30) days of the beginning of the term (the "Money-Back Guarantee Period"), you will, upon your written request to the Webanchor.net Support Team (the "Refund Request") within sixty (60) days of such termination or cancellation ("Notice Period"), receive a full refund of all basic shared, VPS and reseller hosting fees previously paid by you to Webanchor.net for the initial term ("Money-Back Guarantee Refund"); provided that such Money-Back Guarantee Refund shall be due to you only upon your compliance with, and subject in all respects to the terms and conditions of, this Section. Requests for these refunds must be made in writing to the Webanchor.net Support Team. Refunds will only be issued for basic shared, VPS and reseller hosting services and will not include domains, administrative fees, install fees for custom software or other setup fees, nor will they include any fees for any other additional services. Money-Back Guarantee Refunds will not accrue, and shall not be paid under any circumstances, if you do not provide the applicable Refund Request within the Notice Period.

Money-Back policy for dedicated servers and VPS

There are no refunds on dedicated servers and VPS. The thirty (30) days money-back guarantee does not apply to dedicated servers. Managed Shared, Unlimited and Reseller Services. Webanchor.net offers a thirty (30) days money-back guarantee for managed shared, Unlimited, and reseller hosting services only. If you are not completely satisfied with our hosting services and you terminateyour account within thirty (30) days of signing up for the Services, you will be given a full refund of the amount paid for hosting except domaim price,SSL price,administrative charges,bank processing charges and courier charges.The refund will be made through cheque. This money-back guarantee only applies to fees paid for hosting services and does not apply to domains, administrative fees,install fees for custom software or other setup fees, or to any fees for any other additional services.

Refund Eligibility.

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, canceled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund. Violations of this Agreement will waive your rights under the refund policy. Non-refundable Products and Services. There are no refunds on dedicated servers, administrative fees, and install fees for custom software.

Cancellation Process.

Termination or cancellation of the Services may be processed by giving written notice via the cancellation form provided. In such event: (i) you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation and (ii) Webanchor.net may, in our sole discretion, refund all pre-paid fees for basic hosting services for the full months remaining after the effectiveness of such cancellation (i.e. no partial month fees shall be refunded) less any setup fees, applicable taxes and any discount applied for prepayment, provided that you are not in breach of this Agreement. Once we receive your cancellation form and have confirmed all necessary information with you via email, we will inform you in writing (typically email) that your account has been canceled. Your cancellation confirmation will contain a ticket/tracking number in the subject line for your reference and for verification purposes. You should immediately receive an automatic email with a tracking number stating that "Your request has been received...." Webanchor will confirm your request and process your cancellation shortly thereafter. If you do not hear back from us, or do not receive the automatic confirmation email within a few minutes after submitting your cancellation form, please contact us immediately via e-mail. We require all cancellations to be done through the online form in order to (a) confirm your identity, (b) confirm in writing that you are prepared for all of your files and emails to be removed, and (c) document the request. This process aims to reduce the likelihood of mistakes, fraudulent/malicious requests, and to ensure that you are aware that your files, emails, and account may be removed immediately and permanently after a cancellation request is processed. Cancellations for shared and reseller accounts will be effective on the account's renewal date. Cancellations for dedicated and VPS accounts will be effective immediately.

Domain

Domain Renewals.

Domain renewals are billed and renewed thirty (30) days before the renewal date. It is your responsibility to notify Webanchor's Billing department via a support ticket created from support@webanchor.net to cancel any domain registration at least thirty (30) days prior to the renewal date. No refunds will be given once a domain is renewed. All domain registrations and renewals are final. Country base TLDs have different terms & conditions on renewal and customer should need to act accordingly. Like all .com.au, .net.au, .org.au, .ch, .fr, .li, .es, .com.es, .nom.es, .org.es, .pe, .com.pe, .net.pe, .nom.pe, .org.pe, .sg, and .com.sg domains MUST be renewed a minimum of 12 days prior to the expiration date. Anything not renewed by this time will go into a redemption status and, if recoverable, will include an extra fee for recovery. Similarly all .COM.SA domains MUST be renewed 60 days prior to the expiration date. Terms of every CTLD can be found at registry's website

Domain Name Fees.

If your plan includes a free domain name and you cancel within 1 year, our standard fee of $10.10 for the domain name (and any applicable taxes) (the "Domain Name Fee") will be deducted from your refund.

Termination

Webanchor.net may terminate your access to the Services, in whole or in part, without notice in the event that: (i) you fail to pay any fees due; (ii) you violate this Agreement; (iii) your conduct may harm Webanchor or others or cause Webanchor or others to incur liability, as determined by Webanchor.net in our sole discretion; or (iv) as otherwise specified in this Agreement. In such event, Webanchor.net shall not refund to you any fees paid in advance of such termination, and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such termination. Additionally, Webanchor may charge you for all fees due for the Services for the remaining portion of the then current term.

Warranty Disclaimer

Customer acknowledges and agrees that Webanchor.net exercise no control over, and accepts no responsibility for the contents of information hosted on domain or information passing through Webanchor.net host computers, network hubs and points of presence, the Webanchor network or the internet, neither Webanchor.net, its employees, affiliates, agents, distributors, suppliers, third party information providers, merchants, licensors nor the like make any warranties of any kind, either express or implied, including, but no limited to, warranties of merchantability or fitness for a particular purpose or non-infringement for the services, neither Webanchor.net and its portfolio make any warranty as to the results that may be obtained for the use of the services or as to the accuracy, reliability or content of any merchandise contained in or provided through the services, the Webanchor.net is not liable for the content of either data transferred to or from stored by customer or any of your customers via service(s) provided by Webanchor.net. Further more Webanchor.net will not be responsible for any kind of data, web, and information lost incurred due to any reason, hosted at Webanchor.net Server. Webanchor.net assures its customers to take due care in all respects.

Indemnification

Customer will indemnify, defend and hold harmless Webanchor.net and its employees, directors and agents, collectively indemnified parties form and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings or filed by a third party against any of the indemnified parties arising out of or relating to the use of the services.

Force Majeure

Webanchor.net will not be liable for failure or delay in performing its obligations here under if it is beyond its reasonable control, including, without limitation, acts of any governmental body, war, natural disaster insurrection, sabotage, embargo, fire, flood, strike or other disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunication or third party services including DNS propagation, failure of third party software or hardware or inability to obtain raw materials, our power used in or equipment needed for provision of the services. Neither party is liable for any default or delay in the performance of any of its obligations under this Agreement (other than failure to make payments when due) if such default or delay is caused, directly or indirectly, by forces beyond such party's reasonable control, including, without limitation, fire, flood, acts of God, labor disputes, accidents, acts of war or terrorism, interruptions of transportation or communications, supply shortages or the failure of any third party to perform any commitment relative to the production or delivery of any equipment or material required for such party to perform its obligations hereunder.

Acceptance Of Services

It shall be presumed that the customer has read and accepted the terms and conditions framed by webanchor.net on their part.Activation of services shall indicate webanchor.net's acceptance of this agreement. Change of Plans/ Increase in Hosting Quota For further increase in hosting space the formal contract will be rendered inactive and new will be signed thereof as per space acquired and the charges recurring during that set period of time.

Security

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of the installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. You are required to use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change or update your password before suspending your account. The Services, including all related equipment, networks and network devices are provided only for authorized customer use. Webanchor may, but is not obligated to, monitor our systems, including without limitation, to ensure that use is authorized, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. By using the Services, you consent to monitoring for these purposes. Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control requires the express written consent of the third party. Webanchor may, at our discretion, request documentation to prove that your access to a third party network or system is authorized. Any account which causes us to receive an abuse report may be terminated and/or have access to services suspended. If you do not remove malicious content from your account after being notified by Webanchor of an issue, we reserve the right to leave access to services disabled. Webanchor.net reserves the right to migrate your account from one data center to another in order to comply with applicable data center policies, local law or for technical or other reasons without notice.

Network & Resource Utilization

Webanchor.net accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner that impairs network performance is prohibited by this policy and may result in suspension or termination of your account. User are prohibited from excessive consumption of resources, including but not limited to 10% CPU, 200MB Memory, 1024Kbps IOPs of Disk, Database size which is restricted to 100MB and successive session time. However these limitations may vary at different packages. You may not use resource-intensive programs that negatively impact other customers or the performances of Webanchor.net systems or networks. Webanchor.net reserves the right to terminate or limit such activities.

REPORTING VIOLATIONS OF WEBANCHOR.NET POLICY

Webanchor.net requests that anyone who believes that there is a violation of this policy direct the information to the support@webanchor.net if available, please provide the following information:
The IP address used to commit the alleged violation
The date and time of the alleged violation, including the time zone or offset from GMT
Evidence of the alleged violation
E-mail with full header information providing all of the above, as do system log files. Other situations will require different methods of providing the above information. Webanchor may take any one or more of the following actions in response to complaints:
- Issue written or verbal warnings
- Suspend the Member's newsgroup posting privileges
- Suspend the Member's account
- Terminate the Member's account
- Bill the Member for administrative costs and/or reactivation charges
- Bring legal action to enjoin violations and/or to collect damages, if any, cause by violations

REVISIONS TO THIS ACCEPTABLE USE POLICY

Webanchor.net reserves the right to revise, amend, or modify, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service).
